The Capacity plate is required under the Federal Boat Saftey Act of 1971. Boats less than 20' are required to have the capacity plate. NMMA certified manufacturers must have an NMMA certified capacity plate for boats under 26'. Over 26' the NMMA requires a Yacht Certification plate, which does not include any capacity information. And....if i understand it correctly, your regs dont state that the manufacturer has to install the plate so you could simply have one made up with all of the pertinent information normally found on the capacity plate and install a replacement yourself.
All that said, i believe each individual state can set their own regulations but most follow the above rules. I could be corrected on this though.
