hello new owner of 03 mariah sx19

So pissed just bought this Maria boat a month ago. Was going to do a tuneup this weakened and found out the motor is bad. Cracked block and possibly heads. Front 2 frost plugs were out. It was leaking water into heads and out oil dipstick. Bought from a dealer and he really screwed me. Original owner didn't winterrize and blew motor. Going to cost 3000 dollars for a new motor and installation.had a 5.0 and I'm getting a 5.7 put in. Same price for both motors. Anyone had a situation like this what do I do to the dealer. Thank you everyone.

Oh man. Sorry to hear about your bad situation there. That really sucks. Unfortunately, I do not think there is much you can do since it is an "as is sale." Your state might have a special law about it. I know in Florida, you have a 3 day full refund on a vehicle purchase to return it regardless of your reason.(not sure if that applies to boats). This is the main reason why sea trials are so important. And if you can't do a sea trial, then spring the $350-$500 for a complete boat survey.
Sorry to hear about your situation. Maybe someone else on here will have more legal experience with this and can chime in. What state did you purchase the boat in? Let us know how it all pans out.....

Re: hello new owner of 03 mariah sx19

I'm not sure what else you can do if you bought the boat without doing a sea trial (as Chris noted) nor a warranty from the dealer. Was the boat advertised? If so, did the ad mention anything about being winterized or 'ready to use? You could go back to the dealer though and make some noise just to see what happens.

Re: hello new owner of 03 mariah sx19

I bought it in Minnesota. I can't remember what the craigslist ad said. I heard there was a law in Mn protecting me from fraud. I'm going to check it out.

Re: hello new owner of 03 mariah sx19

Was it a "too good to be true" price?

I'm thinking all the seller will have to say is "It worked the last time I took it out".

Re: hello new owner of 03 mariah sx19

"Fraud" is going to be very difficult to prove without the original advertising for the boat. I hate to say it but this will be one of those examples used when people ask about what to do before buying a boat. Best of luck!

rainman55343 05-01-2013 11:17 PM

Re: hello new owner of 03 mariah sx19

The seller didn't use it. The dealer bought it from a bank because it was a repo. The dealer bought it about 2 weeks before I bought it. It was a mess buying it from him. I had to go to him 3 different times because the titles and signatures were wrong to transfer the title. This boat will not be totally fixed after motor. Still needs trailer brakes fixed and some interior work done.

Re: hello new owner of 03 mariah sx19

I guess the only good news is you can't boat on ice here in mn lol but really that sucks. I don't think there is any law for that one but what did the dealer say as they may at least help with something to keep there name good. Is it a twin cities dealer?

mikeyt 05-02-2013 12:03 AM

Re: hello new owner of 03 mariah sx19

You did state in your very first post that you knew the boat had not been winterized when you bought it. And honestly, if it was a repo in Minnesota that wasn't winterized it should have been a clue to possible/likely motor damage. You stated that you found no water in the engine initially and then in your first post of this thread indicated water into the heads and the frost plugs popped? Again, you really should have had someone knowledgeable examine the boat before you laid down your cash and unfortunately now you are paying the price for not doing so. I suspect you will not have much success in going after the dealer who sold it. :(

Re: hello new owner of 03 mariah sx19

The dealer name is Dennison sales in Lakeville Mn. He sells travel camper trailers.he must have got a good deal on the boat at a auction. He offered a couple hundred dollars toward the cost what a joke. I kept telling him u can't fix a cracked block. He says u can what a idiot lol.

rainman55343 05-02-2013 12:08 AM

Re: hello new owner of 03 mariah sx19

I actually didn't know it wasent winterized until I got it home. Then a couple weeks later I found the block cracked and the 2 missing frost plugs. It wasent registed in Mn until me. The last owner had it registered in Wyoming.

Re: hello new owner of 03 mariah sx19

That's probably why the last owner let the bank have it.

Re: hello new owner of 03 mariah sx19

Not to be pushy , but what did you end up giving for the boat? As said it sucks , but your probably better off to bite the bullet and fix her if you don't have a lot vested in it. Short block is around 1750.00 maybe , long block 2200.00. And if you can do the work..........
It pretty much boils down to how much you like the boat.
I got more money in my Diablo than I do in my truck!!

Re: hello new owner of 03 mariah sx19

I paid 9000 for the boat. Bought a lot of stuff for it probably spent another 2000 on parts. Long block is 2200. Total for motor is around 3000. Its a decent boat needs trailer brake work and some cheap interior work.

Re: hello new owner of 03 mariah sx19

In my opinion , your really close to what it is worth. But , if you like her I think in the long run you would be happy when it's all over and your on the water.
Again , this is my opinion , I got approx 6000.00+ invested in my Diablo and still going:yes_grin:(paid 3500.00 for her)

I hope so I like its going to have a 350 now. Just bought a k&n flame arrestor for it. It should fly now. Should go around 60 now with a 4 as prop. Maybe will put a new edelbrock carb on. We will see hope I have better luck after this experience.

Will do. Do u know anything about disc surge brakes.

Re: hello new owner of 03 mariah sx19

Just like your car.
Hydraulic master cylinder with piston controlled calipers.
What's the symptoms?

rainman55343 05-02-2013 02:57 AM

Re: hello new owner of 03 mariah sx19

Master cylinder holds fluid. But I know I don't have brakes. Was going to do pads and rotors. Pads still have a little life left.

Re: hello new owner of 03 mariah sx19

Need to make sure the actuator in the tongue is working. Easiest way I know is back the wheels up against a object and see if the wheels lock up. Not to be mean , but is the lock pin in the coupler at the brake actuator maybe in ? There is a way to bypass the brake system that way.
If not , leave pressure on the trailer up against a object and bleed the system. Longest line first.
If no pressure comes from the bleeder , probably need new actuator at the tongue.
Check for leaks at calipers , fittings , along the lines , etc.

rainman55343 05-02-2013 03:13 AM

Re: hello new owner of 03 mariah sx19

K will check thx. I know if master cylinder is bad I have to get old actuator cut off and get a new one put on. Reliance doesn't make actuators or master cylinders anymore. I had the marina check for me.

rainman55343 05-02-2013 03:14 AM

Re: hello new owner of 03 mariah sx19

My actuator is welded on that sucks.

ColoradoDiablo 05-02-2013 03:17 AM

Re: hello new owner of 03 mariah sx19

Could be just air in lines. If you have access to a air actuated brake bleeder , I'd try that.

update on my 03 mariah with bad motor

Hello is an update on my motor situation. The block is cracked on both sides. Someone already tried to fix it. One side has some kind of putty on it. It matches the color of the motor so its hard to see. Next step legal action against the dealer who sold it to me.

ShabahZ280 05-14-2013 10:06 PM

Re: update on my 03 mariah with bad motor

Yikes..... I'm really sorry to hear that. I hope you do pursue legal action against the dealer. That is just pure neglect on their part. They were most likely aware of the shadetree mechanic fix the entire time, and knew it'd only last temporarily. What a bunch of @$$holes... Seriously, I'd get some legal action going against them, at the very least to get the motor replaced. Sorry man, I hope things can get taken care of for you. Keep us updated.

Re: update on my 03 mariah with bad motor

I will thx. The other bad deal we agreed that he would pay 500 dollars and I would not pursue him for any more. He never paid anything and I have proof that he lied about paying me. I have the proof via text message.

Re: hello new owner of 03 mariah sx19

Your mistakes just keep coming on this one. I feel bad for you and I know its a tough and expensive way to learn a lesson but you didn't ask questions when you bought it, you didn't have someone knowledgeable look over the boat before you handed over your $$$ even though you knew it was a 'repo', you didn't sea-trial the boat and you aren't in a position to prove that the dealer committed any sort of fraud when he sold the 'repo' boat that he bought from a bank because you cant show how the dealer advertised the boat and then you have entered into an agreement to settle your issues for $500. that will likely cost you some court time to get paid and the $500 is no where near the cost of repairing that boat. I think i mentioned this before that this will be one of those examples used when we tell people what not to do when buying a used boat.

rainman55343 05-15-2013 01:43 AM

Re: hello new owner of 03 mariah sx19

We will see. I got some good evidence against him. I think I got a 50/50 chance. I went on the Mn dealers associations website and got some good advice on laws and so forth.the patch on engine think he did. And I will have my marina mechanic write a letter and what he thinks. The mechanic thinks the guy patched it and sold it to me knowing of a cracked block. I was going to be happy with half the cost. But if I get something from him I will be happy.

rainman55343 05-15-2013 01:44 AM

Re: hello new owner of 03 mariah sx19

I did ask questions too. He said it ran good. But I guess I failed to have him run it with water hooked up to it.

mikeyt 05-15-2013 01:48 AM

Re: hello new owner of 03 mariah sx19

I haven't seen anything in your posts that rules out the likelihood that the previous owner blew the motor and attempted to patch it before realizing that it would be simpler and less expensive to just let the bank have the boat. I suggest that you sit down and consult with a real lawyer and show him all of your 'evidence' before you start costing yourself even more money. Because if you go after him in court on your own and lose, you just may be liable for his legal costs too.

Apparently he's not such an 'idiot'. Mechanics have successfully repaired cracked blocks with JB Weld and MarineTex for years and if you really want to get serious about this type of repair there is a product called Belzona that is industrial strength and worth every penny. It can be used internally too. The key to such a repair is the preparation which includes drilling the ends of the crack to prevent it from expanding, cleaning and/or grinding out the crack thoroughly and then applying the compound per the instructions.

rainman55343 05-15-2013 02:21 AM

Re: hello new owner of 03 mariah sx19

Whatever was used on motor didn't work lol. I will update with pics later.the guy said he made only 500 dollars on the boat deal yeah right.that's a lie I'm sure. But I will never know how much he paid for it. Only legal costs for me is a 50 dollar fee for the small claims court. U can't have a lawyer for small claims court so no lawyer fees. I have a free legal advice for a hour from my work.

rainman55343 05-15-2013 02:21 AM

Re: hello new owner of 03 mariah sx19

And the crack is internal too not just external.

rainman55343 05-15-2013 02:24 AM

Re: hello new owner of 03 mariah sx19

And I didn't know how bad the motor was till last Monday.when the marina pulled It from the boat. When the motor was in the boat I didn't know how bad the crack was.

mikeyt 05-15-2013 02:30 AM

Re: hello new owner of 03 mariah sx19

You sound like you figure you have this dealer by the 'short & curlies'. If you have free legal advice then you best take advantage of it and stick to the facts. Note that even Small Claims courts can award costs to a defendant. Best of luck.

btw...did you check the NADA value on this boat?

rainman55343 05-15-2013 02:32 AM

Re: hello new owner of 03 mariah sx19

Its valued at around 12k with a good motor lol.

rainman55343 05-15-2013 02:35 AM

Re: hello new owner of 03 mariah sx19

I paid 9000 for it. I had a lot of work to make it nice too. I just don't get people that don't care of boats and do regular maintnece.

rainman55343 05-15-2013 02:36 AM

Re: hello new owner of 03 mariah sx19

I just don't know why I would have pay him anything though. This situation didn't hurt him it hurt me.
