My Mariah stolen
I went down last week to get my boat out of storage to find out that the storage facility mistakenly sold my boat. Talking pissed off. They say they were doing an abandonment sale and went to my states D.O.R to get an abandonment title an held an auction and sold the boat. Problem is we were not notified and the boat has a lien on it because I owe 1 last payment. The bank says they had no idea and they still have the lien, the state has no idea what happened and now someone else has my dam boat. Contacted my lawyer and said not to worry that if I had to I can sue 3 different entities involved. Starting with the guy that bought it in hopes he would realize he is possession now of a stolen boat. The trailer is still in our name but the boat title is in the new buyers name. After contacting my ststes DOR and spending almoust an hr and a half on the phone they realized they issued a title with a lien on it without contacting the lien holder. 1st mistake, 2ndly no one was contacted, us, the bank or anyone. So it looks like the buyer is going to have to sue the storage facility for his money back, and I am going to sue them for wrongfull sale. Will let you know on how the saga turns out.

Really sorry to hear what you are going thru. It's not exactly a 'stolen' boat (which implies the intent) and i believe the correct term for it is 'conversion' (taking over of property that belongs to another). While it may cost you some legal fees and a bit of time to get your boat returned, it should be a reasonably straight forward process in the courts. And....of course your lawyer will say you can sue! They have to pay for their Ferraris somehow. :)

Sorry to hear about this. It does sound like there is a good chance you'll get it back, just have to wade through some red tape and bureaucracy to get there. Best of luck, and keep us posted...

So, if I can ask... Why were they doing an abandonment sale? Did you forget to pay the storage fees, or did they clean out the wrong unit?

You could consider publishing your story on the storage company's social media, if they have a facebook/twitter page. You'd be surprised how quickly your message spreads, and usually when the business's online reputation is at risk, they're willing to try and rectify the situation quickly and quietly. Just a thought... |

Pay all your legal fees
Restore boat to it's original condition (full detail) and any missing or altered items. Restore all titles at their expense Pay damages (loss of use) and now lack of storage time paid for. |

Well I received all the documentation on the sale of my boat from the state of Mo, and according to the state everything was done on the up and up and they storage facility provided all the propper papers including signed certified lettersor reciepts that they were received and after 30 days of no compliance legally they could sell the boat. But 2 problems The bank did sign for the letter according to the info but denies they ever received it. 2nd its not our signature on ours. But the good news is. I am still the proud owner of the trailer my boat sat on because they didn't apply for a title for it. As well as a proud owner of a useless piece of paper that's called a title that someone else owns. Sweet! Maybe I could put it on my hitch trailer it on my trailer that the guy who owns my boat has and drop it in the lake and see if it floats. Anyone figure out yet why they haven't seen me on the news yet?

I'd be scanning the classifieds for the same boat, less hours, better condition and suggest to the storage company they had better put this boat in your hands asap. For purely legal reasons.... Your son caught his first fish in that boat. Your daughter went water skiing behind it, she was scared but daddy said this boat will help you be a great skier. Your eldest son was going to restore that boat as a legacy to his father and keep it in the family. |

Let your solicitor deal with it. If he/she is any good your boat will eventually be returned or settlement equal to the value of the boat with a little extra goodwill provided by the storage facility or their insurer.

My boat is legally gone and nothing I can do about it but sue the storage guy. But I am in the process of buying a 1999 shabah with a 454 fuel injected rated 375hp with 210 hrs on the clock. 252 model. Excellent condition with new out rageous sterio system, and captains choice exhaust. New prestige trailer. Needs a little love but not much. So we will see from here. Just sucks to have go out and buy another boat.:mad:

I would make them pay for ur old boat, how much it cost u since u will never b able to get it back, and pay for the new boat u want.

There has got to be a criminal charge in there somewhere and definitely negligence... No way I would lay down on this.

/I wish you the best and all will work out. Suing helps only one industry and im sure the buyer doesnt like the situation either.
