Hello friends,
I just got the entire upholstery job done on my '97 Jubilee. I found the folks at Atlantic Coast Canvas in Lexington SC to be extremely helpful in taking the boat to all original graphics. Atlantic owns the original logo (cursive with sunburst) and they digitized the Shield logo for the seatbacks for me. I got 5 seat panels and two shields digitized/embroidered and express shipped for $133 and they are perfect. Call Debbie at 803-808-2522. Lovin this boat!

Glad you got them done , but Sea Fox owns all of the original Mariah trademarks.
As long as they (Atlantic) are willing to take the risk for infrigement on the rights you gotta deal :)

Far as I know they won't do anything like that.

That was part of the reason i wanted to see the embroidery work they did. :) I also understood SF owned the trademark logo.

If I purchase a DVD or CD I have the right to copy it for my own personal use, even if to replace a damaged or missing component or part. Even if I employ someone to make the copy. It's when they (the copy'r) turn around and sell that copy to someone else, is when the lawsuits can happen. They didnt own the original and later sold the reproduction for a profit without permission or compensation to the originator.

If I own the boat I can copy any of it's insignia for my personal use, especially if used in it's original manner to maintain its value as a whole. Even if later I sell the boat.

Read the verbiage sometime on a CD or at the beginning of a DVD.

He is not the one that is infringing on the trademark........The company that did the work and profited from the work is the one looking at issues.

Sea Fox Mariah has the exclusive rights to the Mariah brand, and they are very adamant about not allowing anyone to use it. They even tried to get on us about using it with the site. We spoke to some high ranking officials with SF and got their approval for the site, but they have insisted they own the rights to it, and are beginning on really "cracking down" on anyone using any of their branding logos without their approval.

That is all I'm going to say on the matter:).

I don't disagree with you here, but if you read my post above, SF has every right to pitch a biotch here, as the forum charges a fee for access to information with regards to their product(s) and does not share in any profits from it.

If I employ you to manufacture something for me, that I have every right to own (meaning I purchased it), you have every right to make a profit from it from me and only me. I am the owner of the item that Im having manufactured by you. As long as Im not having you mass produce it and then reselling it to others, then Im in trouble as well.

The key here is that I have not altered the original design, nor placed it in any such place that was not originally intended, Im merely just replacing the item.

If tomorrow I had commissioned some Mariah garments and used the original logo without the express written permission of SF, then resold them for a profit (not even for a profit), they have every right to shut me down, slap some sanctions on me and sue my dead aunt and they would win.

Just my $.02 worth here, but Im amazed that SF hasn't stepped up to offer their blessing on the site and exchanged that for free advertising and some occasional technical support. Youd think the good will that would come from it would help foster new sales and create lasting relationships between the mfg and their customers.

Neither Larry or I are/were privy to any discussions between our Admins and Sea-Fox reps involving support or even acknowledgement of our website. That said, i'd agree that its a little surprising that SF hasn't done more with us other than the obvious like approving the use of the Mariah logo in our masthead. There may be support or agreements in place but we're just not aware, nor is there a need for us be, of the details.
